Rudy Giuliani has announced he won't be part of Donald Trump's legal team when Trump faces his second impeachment trial for "incitement of insurrection" in the US Senate, citing to his involvement in the "Save America Rally" on January 6 where he called for a "trial by combat".

“Because I gave an earlier speech. I am a witness and therefore unable to participate in court or Senate chamber,” Giuliani told ABC News.

The New York State Bar Association is opening an inquiry into removing Rudy Giuliani from its membership over his role in inciting the mob that stormed the U.S. Capitol on January 6.

Giuliani has continuously spread baseless claims and conspiracy theories about the election despite no evidence of voter fraud.

The Bar Association said Monday it has received hundreds of complaints about Giuliani, President Donald Trump's personal attorney and the former mayor of New York City. "Mr Giuliani's words quite clearly were intended to encourage Trump supporters unhappy with the election's outcome to take matters into their own hands," the association said in its statement.

The U.S. President Donald Trump tweeted earlier Sunday his personal lawyer Rudy Giuliani has tested positive for Covid-19.

Mr Giuliani, who has been leading the Trump campaign's legal challenges to the 2020 election results, is the latest person in the president's inner circle to be infected.

The U.S. Third Circuit Court has rejected the Trump campaign’s latest efforts to challenge Pennsylvania's election results on Friday, after Trump’s lawyer Rudy Giuliani argued the case in a lower court last week. Giuliani had insisted that "Pennsylvania continues to cover up the allegations of massive fraud."

"Free, fair elections are the lifeblood of our democracy. Charges of unfairness are serious. But calling an election unfair does not make it so. Charges require specific allegations and then proof. We have neither here," so Judge Stephanos Bibas, who Trump nominated to the Third U.S. Circuit Court of Appeals in 2017.

On Saturday, Pennsylvanian Judge Matthew W. Brann dismissed a lawsuit by the Trump campaign that sought to delay the certification of Pennsylvania’s vote results, claiming widespread improprieties with mail-in ballots in the state.

Brann stated that his "court has been presented with strained legal arguments without merit and speculative accusation" and that "this cannot justify the disenfranchisement of a single voter, let alone all the voters of its sixth most populated state."

Rudy Giuliani, President Trump's personal lawyer, said in a statement he would appeal against the ruling: "Today's decision turns out to help us in our strategy to get expeditiously to the US Supreme Court."

Citing four people familiar with the matter, Giuliani is now responsible for overseeing the lawsuits to throw out ballots and turn around Trump's election loss. As Donald Trump played golf on Saturday morning, his personal lawyer Rudy Giuliani was surprised on camera during a press conference by the announcement of Joe Biden's win in the presidential election.

Earlier confusion regarding the location of the press conference had led the Four Seasons Hotel Philadelphia to tweet that it was not being held at their premises, but at an unrelated outdoor area, described by the Deutsche Welle news agency as "a parking lot between a crematorium and an adult book store."

"I have not resigned", US Attorney Geoffrey Berman not stepping down

United States Attorney for the Southern District of New York Geoffrey Berman issued a press release shortly after William Barr announced Berman's resignation. "I learned in a press release from the Attorney General tonight that I was ‘stepping down’ as United States Attorney. I have not resigned, and have no intention of resigning, my position".

Berman has been in the office since 2018 and has investigated several of Donald Trump's associates. His office is investigating Rudy Giuliani and has prosecuted Michael Cohen, Trump's former attorney.

"I will step down when a presidentially appointed nominee is confirmed by the Senate. Until then, our investigations will move forward without delay or interruption. I cherish every day that I work with the men and women of this Office to pursue justice without fear or favor – and intend to ensure that this Office’s important cases continue unimpeded," so Berman in his statement.

Rudy Giuliani tweets Covid-19 misinformation, gets temporarily suspended

Over the weekend, Rudy Giuliani's Twitter account got temporarily suspended after tweeting misinformation regarding Covid-19. The tweet, a quote by conspiracy theorist and conservative activist Charlie Kirk, stated "Hydroxychloroquine has been shown to have a 100% effective rate treating COVID-19 yet Democrat Gretchen Whitmer is threatening doctors who prescribe it. If Trump is for something - Democrats are against it. They're okay with people dying if it means opposing Trump." The drug hydroxychloroquine has been used to prevent and treat malaria but hasn't been proven to be a safe or effective cure for the coronavirus.
